Why should I care? These Terms & Conditions are the “house rules” for using the Camila Saunier International Realty website (the “Site”). They set the expectations for agents, investors and casual browsers. Reading them protects you and us. We know it’s not as exciting as touring a penthouse in Leblon, but hang with us—this is important.

1. Acceptance of Terms

By accessing or using camilasaunier.com (the “Site”) and the services offered through the Site (the “Services”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to the Terms, please don’t use the Site. We may update these Terms from time to time; the date of the latest revision appears above. Continuing to use the Site after we post revisions means you accept the updated Terms.

We are Camila Saunier International Realty, a luxury real‑estate platform specializing in high‑end properties in Brazil for affluent international clients. Throughout these Terms, “Camila Saunier,” “we,” “our” and “us” refer to Camila Saunier International Realty. “You” and “your” refer to any person accessing the Site or Services, including registered agents and prospective buyers.

2. Definitions

• Account – A personalised profile created by a user or agent to access certain features of the Site, such as listing properties or saving favourites.
• Agent – A licensed real‑estate professional or authorised representative who registers on the Site to list properties for sale, lease or rent.
• Content – All material posted on the Site, including property listings, photos, text descriptions, comments, reviews and other user‑generated content.
• Listing – An advertisement or property description posted on the Site.
• Services – Any service provided through the Site, including property listings, messaging functions, property comparisons, account services and related resources.

3. Eligibility & Account Registration

1. Minimum Age & Capacity. You must be at least 18 years old and legally capable of entering into a binding contract to use the Services. By creating an Account, you represent that you meet these requirements. If you are accessing the Site on behalf of a business or organisation, you warrant that you have authority to bind that entity.
2. Accurate Information. When you register, you must provide accurate, current and complete information. Keep your login credentials confidential and notify us immediately of any unauthorised use. You are fully responsible for all activities that occur under your Account.
3. Account Security. We may suspend or terminate your Account and refuse any and all current or future use of the Site if we suspect that the information you provided is false, misleading or violates these Terms. In plain English: don’t pretend to be someone you’re not and don’t share your password with others.

4. Permitted Use & Restrictions

We grant you a non‑exclusive, non‑transferable, revocable licence to use the Services for your personal or professional real‑estate activities. You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

1. Post false or misleading content. All descriptions, prices, square footage and other property information must be accurate. You will update or remove Listings as circumstances change (e.g., when a property is sold).
2. Upload content you do not own. You must own or have permission to use any photographs, videos or text you post. You are responsible for obtaining any necessary releases and authorisations.
3. Infringe intellectual property rights. Do not reproduce, distribute or create derivative works from Site content without our consent. Our trademarks, logos and proprietary information are protected.
4. Harass or spam other users. You may contact agents or prospective buyers through the Site, but you must not send unsolicited marketing, harass, stalk or otherwise abuse any user.
5. Circumvent security or misuse the Site. No hacking, scraping, data‑mining, reverse engineering or interfering with the proper operation of the Site.

We reserve the right to monitor use of the Site and remove content or suspend users for any violation of these Terms.

5. Agent‑Specific Obligations

If you register as an Agent, you agree to the additional provisions below:

1. Licensure & authority. You represent and warrant that you are duly licensed and authorised to act as a real‑estate agent in the jurisdiction where your Listings are located. You will comply with all applicable laws, regulations and professional standards relating to advertising, marketing and real‑estate services.
2. Accuracy of Listings. You will only list properties for which you have authority to market. You must ensure that the information provided in each Listing (including price, availability, amenities and ownership) is accurate and not misleading. If the status of a property changes, you will update the Listing promptly.
3. Photos & media. You must have lawful rights to use and display any photos, videos or other media in your Listings. This includes obtaining consent from photographers, owners, tenants or other rightsholders.
4. Non‑exclusivity. Posting a Listing on the Site does not create an exclusive marketing relationship with Camila Saunier. You remain free to advertise the property through other channels, subject to the terms of any agreements you have with the property owner.
5. No brokerage relationship. Camila Saunier provides a platform for connecting buyers and agents. We are not a party to any purchase, sale or lease agreement. You acknowledge that we are not acting as your broker, agent, fiduciary or representative and that we do not collect commissions on property transactions.

6. User‑Generated Content & Licence

1. Ownership. You retain ownership of the content you upload to the Site. However, by posting Content, you grant us a worldwide, royalty‑free, non‑exclusive licence to use, reproduce, publish, display, perform, adapt and distribute that Content in connection with operating and promoting the Services. This licence lasts as long as your Content is displayed on the Site and for a reasonable period after removal for backup and archival purposes.
2. Responsibility. You are solely responsible for any Content you post. You represent and warrant that: (i) you have all rights necessary to post the Content; (ii) your Content does not violate any law or regulation; (iii) your Content does not infringe any third party’s rights. We reserve the right (but have no obligation) to remove or edit any Content that we believe violates these Terms or is otherwise inappropriate.
3. Feedback. If you send us comments or suggestions about the Site, you grant us the right to use that feedback without obligation or compensation to you.

7. Intellectual Property Rights

All content and materials on the Site—including but not limited to text, graphics, trademarks, logos, icons, images, audio clips, video clips, data compilations and software—are owned or licensed by Camila Saunier and are protected by international copyright, trademark and other intellectual‑property laws. You may print or download portions of the Site for your personal, non‑commercial use, provided that you retain all proprietary notices. Any other use, including the reproduction, modification, distribution, transmission, republication, display or performance of the Site content, is strictly prohibited without our prior written consent.

8. Fees & Payment

1. Listing fees. We may charge fees for certain Services (e.g., enhanced Listing packages, featured Listings or access to premium features). If we do, the applicable fees and payment terms will be disclosed at the time of purchase.
2. Third‑party processors. Payments may be processed through third‑party services. You agree to comply with the terms of those processors and authorise us to charge your selected payment method for any fees due.
3. No guarantee of sale. Payment of any fee does not guarantee that your property will sell, lease or generate inquiries. The Site is a marketing platform; success depends on many factors outside our control. We make no promises regarding the number of leads or the outcome of any Listing.
4. Refunds. Unless expressly stated otherwise, all payments are non‑refundable.

9. Communications & Marketing

By using the Services, you consent to receiving electronic communications from us (e.g., emails, text messages, in‑platform messages) regarding your Account, Listings or inquiries. You may also choose to receive newsletters, marketing or promotional communications. You can opt out of non‑transactional communications at any time by following the instructions in those messages. Note that opt‑out requests may take up to 10 business days to process and will not apply to transactional messages.

10. Third‑Party Links & Services

The Site may contain links to third‑party websites or services that are not owned or controlled by Camila Saunier. We provide these links solely for your convenience. We have no control over and assume no responsibility for the content, privacy policies or practices of any third‑party site. Accessing any third‑party site is at your own risk.

11. Privacy

Protecting your privacy is important to us. Our Privacy Policy explains how we collect, use, store and disclose your personal information. By using the Site, you consent to our collection and use of your information as described in the Privacy Policy. You assume all risk for any reliance on the Site, and you should independently verify information and consult professional advisors before making any real‑estate decisions.

13. Limitation of Liability

To the maximum extent permitted by law, Camila Saunier and its affiliates, officers, directors, employees, agents and representatives will not be liable for any direct, indirect, incidental, special, consequential or punitive damages, including without limitation loss of profits, data, goodwill, use or other intangible losses arising out of or relating to your access to or use of (or inability to access or use) the Site and Services, even if we have been advised of the possibility of such damages.

If, notwithstanding the foregoing, we are found liable for any damage or loss arising from your use of the Site, our liability will not exceed the greater of (i) the amount you paid (if any) to us for the Services that gave rise to the claim during the twelve (12) months preceding the event giving rise to the liability, or (ii) 100 USD.

14. Indemnification

You agree to indemnify, defend and hold harmless Camila Saunier and its affiliates, officers, directors, agents, partners and employees from and against any claims, losses, liabilities, damages, judgments, awards, costs and expenses (including reasonable attorneys’ fees) arising out of or relating to (i) your use of the Site or Services, (ii) your violation of these Terms, (iii) your Content or Listings, or (iv) your violation of any rights of another person or entity.

15. Termination

We may terminate or suspend your Account and access to the Services at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or illegal activities, or acted in a manner that is harmful to our interests or those of other users. Upon termination, all licences and rights granted to you under these Terms will immediately cease, and you must cease all use of the Site. Provisions that by their nature should survive termination (e.g., ownership, indemnity, limitations of liability) will survive.

16. Governing Law & Dispute Resolution

These Terms and any dispute arising out of or relating to the Site or Services will be governed by and construed in accordance with the laws of the State of São Paulo, Brazil, without regard to its conflict‑of‑laws principles. You agree that any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in São Paulo, Brazil, and you consent to the jurisdiction of such courts. If you access the Site from another country, you are responsible for compliance with your local laws to the extent they apply.

17. Changes to the Terms

We may revise these Terms at any time by posting an updated version on the Site. The “Last updated” date at the top of this page indicates when the latest changes were made. If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent possible, and the remaining provisions will remain in full force and effect.

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorised representative of Camila Saunier.
